Terms of Service

These Terms of Service (“Terms”) govern your use of 5D Rising, operated by 1001555452 Ontario Inc. By creating an account, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that is older than 18, and legally able to enter into a binding contract to use 5D Rising. By creating an account, you confirm you meet this requirement.

2. Not Professional Advice

5D Rising's AI coach provides general coaching conversation and is not a substitute for professional medical, legal, financial, investment, or mental health advice. The coach never diagnoses conditions, prescribes treatment, or guarantees any outcome. If you are experiencing a medical or mental health emergency, contact emergency services or a crisis line immediately.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions and Billing

• 5D Rising offers a Free tier and paid subscription tiers (Essential, Executive, and Executive Plus), each with different features and voice-minute allotments as described in the app.
• Paid subscriptions automatically renew at the end of each billing period unless cancelled beforehand.
• A free trial may be offered on eligible plans; unless cancelled before the trial ends, it converts automatically to a paid subscription.
• Subscriptions purchased through the Apple App Store or Google Play are billed and managed through those platforms, subject to their respective terms.
• You may cancel at any time through your device's subscription settings, or through the app directly. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time except where required by law or platform policy.
• Additional voice-minute top-ups are one-time purchases and are non-refundable once delivered, except where required by law.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or extract the underlying AI models or system prompts.
• Use the service to harass, abuse, or harm others.
• Misrepresent your identity or age.
• Attempt to circumvent usage limits, security measures, or subscription restrictions.

6. Your Content

You retain ownership of the content you share with your coach. By using the service, you grant us a limited license to process that content solely to provide and improve the coaching service, as described in our Privacy Policy. We do not claim ownership of your personal content.

7. Intellectual Property

5D Rising, including its personas, design, and underlying software, is owned by 1001555452 Ontario Inc. and protected by applicable intellectual property laws. You may not copy, modify, or redistribute any part of the service without permission.

8. Disclaimer of Warranties

5D Rising is provided “as is” without warranties of any kind, express or implied. We do not guarantee the service will be uninterrupted, error-free, or that any particular outcome will result from using the coaching service.

9. Limitation of Liability

To the maximum extent permitted by law, 1001555452 Ontario Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account for violation of these Terms, including but not limited to misuse of the service or providing false age information. You may delete your account at any time.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
